業主賣樓遇難題:買家簽完臨時買賣合約忽然過身點算?

喺房屋買賣上,通常都係聽到買家或者租客遇疑難,但原來作為賣家,都一樣會遇上令人進退兩難的局面,有賣家就在連登討論區上求救:「簽完臨約後買家過身,應該點處理?」大家有甚麼提議呢?

對於這個突發情況嘅詳情,樓主表示:「買家後人已通知想繼續交易,但要延遲,唔可以如期俾大訂,如果唔想拖得耐,究竟係殺訂取消交易定退訂取消交易?本身我打算當然如期完成交易,不過搞遺產承辦at least要3個月,無論取消交易與否,基本上我間屋都hold住幾個月,所以先咁困擾係呢個問題!」

網友就唔建議殺訂:「退訂算啦,人都死咗,殺訂太無良。」、「如果對你影響唔大就退錢算啦,呢啲錢拎咗唔安樂」。有網友建議可以等耐少少:「揸正嚟做你有權殺,但對家唔係玩野/特登,陰質錢嚟,收唔收得落就你諗你!如果我係賣家,應該會睇要hold幾耐,等得到就得(within 1個月),等唔到就扣晒所有開支退訂算!對買家屋企都係一個小安慰」。亦有網友建議樓主向買家家人收大訂,看對方反應再決定:「你做好人唔殺訂係可以,但佢連大訂都俾唔,無咩誠意,問題係細訂你收左幾多?如果收得少少HOLD你幾個月,到時樓價跌咗,佢撻你訂,你做好人做到蝕本!係我會要求佢俾左大訂先,俾唔到你再睇下殺佢訂,定繼續做好人退返俾佢」。

網民認為原有買家離世,若賣家殺訂,有點無良。

亦有網民覺得可以問買家家人攞大訂,或者定下限期,以免因處理遺產等事宜而無了期等。

不過好多網友就傾向叫樓主退訂:「今星期勁多人出街睇樓,升返少少,退訂再賣啦!」、「佢屋企人想買,點解唔取消咗份舊臨約,同佢屋企人簽份新臨約?!咁咪唔使牽涉遺產呢啲麻煩嘢。但係佢屋企人要拎到遺產先有錢買?如果係咁,你都係退返訂再賣過算」、「退訂先,你自己個心好過啲,如果佢屋企人真係想再訂先算,但照樣放番個盤出嚟」

近期樓市再度活躍,不少網民就建議樓主索性先退訂,如果買家家人想繼續購入原來單位,再另簽訂新合約。
